Terms of service

These terms govern your use of Nyuchi products. By signing up for or using a Nyuchi product you agree to them. The products are provided byNyuchi Africa (Pvt) Ltd, a company registered in Zimbabwe and the commercial pillar of the Bundu ecosystem, operating under a service agreement with the Bundu Foundation.

The products

These terms apply to every Nyuchi Africa product and surface, including:

  • Nyuchi API Platform — API keys, billing, and developer portal.
  • Nyuchi Web Services — engineering and platform delivery.
  • Nyuchi Tools — Workspace Tools and email signatures, Nyuchi Studio, the MCP server, SEO Manager, Mailsense, and Social Proof.
  • Nyuchi Weather Stations and the StationKit hardware programme.
  • Nyuchi Logistics (beta), Nyuchi Pay and Nyuchi Masasa (in development).
  • Nyuchi Learning and the Lingo, Development, and Foundation divisions.

Individual products may carry additional product-specific terms or order forms; where they conflict with these general terms, the product-specific terms control for that product.

Accounts

You are responsible for your account credentials, for API keys issued to you, and for activity under your account. Keep credentials secure and tell us promptly if you suspect misuse. You must be able to form a binding contract to use paid tiers.

Acceptable use

You agree not to:

  • Break the law in or through our products.
  • Use the platform to harm people or infringe others' rights.
  • Extract data en masse, or scrape, without permission.
  • Attempt to access customer environments that are not yours, or probe, breach, or overload our systems.
  • Resell or provide the products to third parties except as your plan allows.

Your content and data

You keep ownership of the data and content you put into the products. You grant us the limited licence needed to host and process it so we can provide the service. We handle personal data as described in ourPrivacy notice.

Fees

Paid tiers are billed as set out at sign-up or in your order form. Fees are exclusive of taxes unless stated. Non-payment may lead to suspension after notice.

Service levels

Free and Team tiers are best-effort, with our public status page as the source of truth. Enterprise customers receive a contractual SLA aligned with their workload.

Termination

You can leave at any time and take your data with you. We can suspend or terminate accounts that violate these terms, with notice and a chance to cure where reasonable, and immediately where required to protect the platform or other customers.

Warranties and liability

Except as expressly stated, the products are provided "as is" and we disclaim implied warranties to the extent permitted by law. Our aggregate liability is capped at the fees you paid for the product in question in the trailing twelve months. Standard carve-outs apply for fraud, gross negligence, and other liability that cannot be limited by law.

Governing law

Zimbabwean law governs this agreement, with disputes settled by arbitration in Harare unless local law dictates otherwise.
